Effective Wednesday, Oct. 28, at 6 a.m. CDT, the Louisiana Public Service Commission (LPSC), in response to a state of emergency from Tropical Storm/Hurricane Zeta, is restricting telephonic solicitations into the state through Nov. 24, 2020, unless terminated sooner, according to a notice on the LPSC website.
As ACA International has confirmed in the past, this temporary prohibition does include debt collection calls.
The statement on the Louisiana Public Service Commission’s website is as follows:
The Louisiana Homeland Security and Emergency Assistance and Disaster Act, R. S. 29:721, et seq., confers upon the governor of the state of Louisiana emergency powers to deal with emergencies and disasters, including those caused by fire, flood, earthquake or other natural or man-made causes, in order to ensure that preparations of this state will be adequate to deal with such emergencies or disasters and to preserve the lives and property of the people of the state of Louisiana.
During a state of emergency as declared by the governor, while the Office of Homeland Security and Emergency Preparedness requires the Louisiana Public Service Commission to report to the Emergency Operations Center ("EOC"), no telephonic solicitor shall engage in any form of telephonic solicitation. As of October 28, 2020, 6 AM CST, the Louisiana Public Service Commission will be required to report to the Office of Homeland Security and Emergency Preparedness in response to the state declaration of emergency in preparation for Tropical Storm/Hurricane Zeta. The state of emergency, 144 JBE 2020 extends from October 26, 2020, through November 24, 2020, unless terminated sooner. The prohibition to telephonic solicitations will remain in effect until the EOC releases the LPSC from this mandatory reporting status.
Upon release of the Commission by the Office of Homeland Security and Emergency Preparedness, from its duties at the EOC, a revised notice will be posted at that time to reflect any change to this telephonic solicitation prohibition
ACA encourages members to use their judgment and discretion when contacting consumers who may be impacted by the state of emergency and the storms and consult with their counsel for guidance if needed.
