Douglas County adopted a pair of ordinances to address emergencies.
One allows the county board to declare an emergency when civil unrest or disasters impairs transportation, food or fuel supplies, medical care, fire, health and police protection or other critical local government critical systems. The other outlines the duties and authority of the public health officer.
Douglas County Board Chair Mark Liebaert presented the ordinances on the recommendation of the Wisconsin Counties Association.
The first measure restrict the declaration to the time period in which the emergency conditions are likely to exist and permits the county administrator and county board chair to use a proclamation to declare an emergency until the county board is able to take up the matter. The board could ratify, modify or repeal the proclamation when it is able to meet.
It allows the county board to order whatever is necessary to protect the health, safety and welfare of people and property within Douglas County and allows the board to acknowledge any order from the public health officer.
The public health officer has a duty to immediately investigate and take necessary measures to prevent or suppress the progress of communicable diseases and to inform the county board and Wisconsin Secretary of Health. The ordinance grants authority to inspect public buildings for sanitary conditions and do what is reasonable and necessary to suppress the spread of disease.
It also prohibits individuals from interfering with a public health investigation and gives the public health officer the authority to issue fines if someone violates the ordinance. Fines range from $100 to $500 for each violation.
“The emergency declaration that the county declared (in response to COVID-19) is given to us by the state, under their rules and regulations,” Liebaert said. “It was recommended that we adopt our own version of that. It makes it a little cleaner, easier if we have to adopt an emergency declaration in the future.”
